Terms of Use for Muy Verbs

1. Acceptance of Terms

Welcome to Muy Verbs (the “Application” or “Service”), provided by 2Day Communications GmbH (“we,” “us,” or “Owner”). By downloading, accessing, or using the Muy Verbs mobile application, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the Application.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 2Day Communications GmbH regarding your use of the Application.

2. Description of Service

Muy Verbs is a language learning application designed to help users master verb conjugation in [specify language(s), e.g., Spanish, French, etc.]. The Service includes:

Interactive verb conjugation exercises
Personalized learning paths
Progress tracking and analytics
Offline access to content (where available)

3. User Accounts & Registration

3.1 Account Creation

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@2daycom.com of any unauthorized use.

3.3 Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Application. Users under 18 require parental or guardian consent.

4. Subscriptions, Payments & In-App Purchases

4.1 Free vs. Premium Access

Muy Verbs offers both free and premium (paid) features. Premium features are accessible via subscription or one-time in-app purchases.

4.2 Payment Processing

All payments are processed securely through third-party platforms:

Apple App Store (for iOS users) play.google.com
Google Play Store (for Android users) play.google.com
RevenueCat (subscription management)
Stripe (direct payment processing)

By making a purchase, you agree to the respective platform’s terms of service and authorize the applicable payment method.

4.3 Subscription Terms

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
You can manage or cancel subscriptions via your device’s app store settings.
No refunds are provided for partial subscription periods, except where required by applicable law.

4.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect active subscriptions until the next renewal cycle.

5. Intellectual Property Rights

5.1 Ownership

All content within the Muy Verbs Application—including but not limited to text, graphics, logos, verb databases, exercises, software, and design—is the exclusive property of 2Day Communications GmbH or its licensors and is protected by Swiss and international copyright, trademark, and intellectual property laws.

5.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install the Application on devices you own or control
Use the Service for personal, non-commercial purposes

5.3 Restrictions

You may not:

Copy, modify, reverse engineer, or create derivative works of the Application
Redistribute, sell, lease, or sublicense the Application or its content
Use automated scripts or bots to access or scrape content from the Service
Remove any copyright, trademark, or proprietary notices

6. User Conduct & Acceptable Use

You agree to use Muy Verbs only for lawful purposes and in accordance with these Terms. You shall not:

Use the Application to harass, abuse, or harm others
Upload or transmit viruses, malware, or malicious code
Interfere with the security, functionality, or performance of the Service
Attempt to gain unauthorized access to any part of the Application or its systems
Use the Service in any way that violates applicable local, national, or international law

Violation of these provisions may result in immediate termination of your account and access to the Service.

7. Third-Party Services & Integrations

The Application integrates with third-party services to enhance functionality. These include:

8. Disclaimers & Limitation of Liability

8.1 “As Is” Service

The Application is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

8.2 No Educational Guarantee

While Muy Verbs is designed to support language learning, we do not guarantee specific learning outcomes, fluency, or academic results.

8.3 Limitation of Liability

To the maximum extent permitted by applicable law (including Swiss law and the FADP), 2Day Communications GmbH shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of data, profits, or business opportunities arising from your use of the Service
Any claims exceeding the amount you paid for the Service in the 12 months preceding the claim

8.4 Force Majeure

We are not liable for failures or delays in performance due to circumstances beyond our reasonable control (e.g., natural disasters, war, terrorism, internet outages, or government actions).

9. Termination

9.1 By You

You may stop using the Application at any time. To cancel a subscription, follow the instructions in your device’s app store settings.

9.2 By Us

We reserve the right to suspend or terminate your access to the Service, with or without notice, if you:

Breach these Terms
Engage in fraudulent or abusive behavior
Fail to pay applicable fees

Upon termination, your right to use the Application ceases immediately. Provisions that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) shall remain in effect.

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

10.2 Data Protection Compliance

Our processing of your personal data complies with:

If you are a consumer residing in the EU, UK, or other jurisdictions with mandatory consumer protection laws, nothing in these Terms limits your statutory rights.

13. Miscellaneous

Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force.
Waiver: Our failure to enforce any right or provision shall not be deemed a waiver.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and 2Day Communications GmbH regarding the Application.
Language: These Terms are originally drafted in English. In case of discrepancy between translations, the English version shall prevail.
